Problems encountered in the application of laws and their remedies: An analytical study in the light of Islamic teachings

Abstract

The effective implementation of laws is a cornerstone of justice, equality, and the stability of any society. Despite robust legislation, numerous barriers hinder the practical application of legal provisions, leading to widespread societal dissatisfaction and injustice. This analytical study explores these challenges through the lens of Islamic teachings, aiming to identify the root causes and propose meaningful remedies. Among the key issues discussed are ambiguity in legal language, inconsistent enforcement, institutional inefficiencies, political interference, and lack of public legal literacy. The research argues that these obstacles not only weaken the rule of law but also erode public trust in the justice system. Drawing upon foundational principles of Islamic jurisprudence (Fiqh), such as ʿAdālah (justice), Maṣlaḥah (public interest), Shūrā (consultation), and Istiṣlāḥ (reform), this paper demonstrates that Islamic law is both comprehensive and adaptable. It emphasizes that the ethical framework of Shariah encourages equitable governance, transparency, and accountability. The study suggests that meaningful legal reform in Muslim societies must incorporate both procedural efficiency and moral consciousness, as reflected in Islamic traditions. Moreover, an inclusive approach involving public engagement, institutional restructuring, and judicial integrity is essential for resolving these systemic issues. This paper contributes to the ongoing discourse on law enforcement by offering an Islamic analytical perspective on how the gap between law-making and its application can be bridged for the betterment of society.
